Acceptance of terms

By using this website, you agree to these Terms of Use and the Privacy Notice. If you do not agree, please do not use the website. Royal Equity may revise these terms by posting an updated version with a new review date.

General information only

Website content is provided for general informational purposes and may be used in connection with general solicitation under Rule 506(c). The website is not itself an offer to sell a security, does not accept an offer to purchase a security, and does not provide legal, tax, accounting, investment, or other professional advice.

Investment documents control

Any offering by Royal Equity Fund, LLC is made only through the then-current PPM, Subscription Agreement, Operating Agreement, applicable Individual Investment Terms Memo, and other definitive documents. Those documents contain material terms, conflicts, fees, restrictions, and risks and control over any inconsistent website statement. Access to information does not establish eligibility or require the Manager to accept a subscription or allocation.

No advisory or fiduciary relationship

Use of the website, an email response, a meeting, or access to general information does not create an investment advisory, fiduciary, professional, partnership, agency, or client relationship. Prospective investors are responsible for their own diligence and should consult their independent advisers.

Permitted use

You may use the website for lawful personal or internal business purposes. You may not attempt to disrupt the site, evade security controls, gain unauthorized access, introduce harmful code, scrape or harvest information in a manner that burdens the service, impersonate another person, or use the content in a misleading or unlawful offering or promotion.

Intellectual property

Website text, branding, logos, design, photographs, maps, graphics, and other content are owned by Royal Equity or used with permission and are protected by applicable intellectual-property laws. No license is granted except the limited right to view the site for its intended purpose. Written permission is required to reproduce, modify, publish, distribute, or commercially exploit the content.

Accuracy and availability

Royal Equity seeks to provide useful information but does not warrant that website content is complete, current, error-free, or suitable for a particular purpose. Strategies, personnel, addresses, available opportunities, terms, and service providers may change. The website may be interrupted, modified, or withdrawn without notice.

Third-party services and links

Third-party links, including the Avestor-powered investor portal and Modesto Silos website, are provided for convenience. Royal Equity does not control and is not responsible for their content, availability, security, privacy practices, or terms. Accessing a third-party service is subject to that provider's policies.

Disclaimer of warranties

To the fullest extent permitted by applicable law, the website and its content are provided on an “as is” and “as available” basis without express or implied warranties, including warranties of accuracy, availability, merchantability, fitness for a particular purpose, noninfringement, or security. Nothing in these terms excludes a warranty or right that cannot lawfully be excluded.

Limitation of liability

To the fullest extent permitted by applicable law, Royal Equity and its affiliates, managers, officers, personnel, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from website use, inability to use the website, reliance on general website content, or third-party links. This limitation does not apply where liability cannot lawfully be limited.

Severability and no waiver

If any provision of these terms is found unenforceable, the remaining provisions will continue to the extent permitted by law. A failure to enforce a provision is not a waiver of the right to enforce it later.
